The website www.kochigallery.com (the “website”), owned and operated by KOCHI Gallery SAS (“KOCHI Gallery”, the “Gallery” the “Company”), a company registered in France with a capital of 10,000 euros (SIREN: 802 246 132), is an online art gallery aiming to offer for sale artworks owned by artists, galleries, or private collectors. Its registered address is 105 avenue André Morizet, 92100 Boulogne-Billancourt, France.
Your use of the website indicates that you have read, understood and agree to the Terms of Use. If you do not agree to these Terms, you may not access or use the website.
In order to improve our service, we may require changing the Terms Of Use, which we will do without notifying you. The Terms Of Use available herein are solely applicable from their date of publication.
All contents of the website, including but not limited to texts, comments, pictures, images, audio and video recordings, are protected by copyright laws, and are owned or controlled by us or by third parties that have licensed their materials to us.

You acknowledge and agree that you are solely responsible for the accuracy and content of the information you provide us.
As a French registered company, the KOCHI Gallery only warranties that the content of its website is appropriate according to and compliant with French legislation.
Users from other countries do so on their own initiative and are responsible for compliance with their respective local legislations.
All users agree to comply with the applicable laws in connection with their use of the website, including but not limited to viewing, commenting, purchasing or selling.
The Terms of Use are governed by French law.
The parties give jurisdiction to the courts of Paris to decide on all disputes between the parties related to the performance or interpretation of these Terms of Use.
However, before going to courts, the relevant parties commit to attempt an amicable solution to their disputes within one month of notification of the dispute by either party to the other by registered letter or email with acknowledgement of receipt.
The website may contain links to third-party websites not operated by us. These links are provided solely for the convenience of the user and are not endorsed by us in any way.
We are not responsible for the content of linked third-party websites and we do not make any representations regarding the content or accuracy of materials on such third-party websites.
Prices mentioned in the website are prices excluding eventual taxes and shipping costs which may be added up when the buyer selects the shipping destination in its "Cart". Eventual import duties and import taxes are the sole responsibility of the buyer, who may search for the relevant information beforehand.
Payments are made to the KOCHI Gallery through credit card, Paypal or bank transfers. The KOCHI Gallery reserves the right to cancel the sale in case it has not received the buyer’s payment within 5 workdays after receipt of the invoice by the buyer.
If necessary, the Gallery orders an adapted packaging from a specialised company, who will, if possible, pack the artworks in coordination with the seller. The Gallery then programs the pickup of the package by a professional carrier (ColiPoste, Chronopost, UPS, FedEx) in coordination with the seller. The shipment must be insured ad valorem up to the resale price exclusive of VAT. The buyer pays the shipping costs, which add up to the price excluding taxes in the "Cart".
The Gallery or the seller can also deliver the artworks in person to the buyer. Finally, the buyer can also pick up the artworks in person at their location, which is indicated in each artwork’s description page.
The buyer becomes responsible of the artworks as soon as he or she accepts delivery.
Unless he or she comes to pick them up in person, we do our best so that the buyer receives his or her artworks within 10 days after receipt of his or her payment.
Once his or her order has been shipped, the buyer will receive by email a tracking number allowing him or her to monitor his or her shipment status.
The Gallery offers the buyer a 14-day return period starting from the date of receipt of the work by him or her.
If a buyer exercises his or her right of withdrawal, the sale between the Gallery and the buyer is cancelled. The Gallery reimburses the buyer the price including shipping costs he or she paid within 7 days of receipt of the returned work. Return shipping costs are payable by the buyer.
The buyer who wishes to exercise his or her right of withdrawal shall contact the Gallery as soon as possible at info@kochigallery.com.
